Belarusian draft law on informatization passed first hearings at the parliament

Belarusian draft law on On Information, Informatization And Information Protection passed first hearings at the parliament during the parliament meeting on December 12, 2007.

Speaking at the parliament, Belarusian minister of Communications and Informatization to Nikolai Pantelei stressed that the law is intended to regulate access to public information, methods of protection of state information systems, and personal data protection.

Acording to the law the right for information access could not be used to propagate violence against authorities, religious, race and other forms of intolerance and of destructive actions.

According to N. Pantelei, the draft law also stipulates requirements to creation, exploitation and and state registration of information systems. The daft law is also represent government's efforts to create a list of data or information resources which governmental agencies will be obliged to provide for citizens. The draft also regulates issues concerning mass media, including electronic ones. At the same time, the minister stressed that the draft law dos not include any provisions for regulation of "internet behaviour". But the draft law includes the right of a citizen "not to receive information which is imposed on him". This provision, according to the minister concerns issues connected with spam.

The head of the Belarusian Association of Journalist Center for Legal Protection of Mass Media Mikhail Pastukhov says that the law could influence Belarusian web sites. "There are such concepts as information network, information resource and information system in the draft law," stresses M. Pastuchov . Consequently, internet users, web sites and portal owners will be subjected to the law. If adopted, the law will regulate journalists' activities and mass media, including ways of information distribution and information usage.
